DEVILS ADVOCATE: IMPUNITY WITH AN EXCEPTION

The statements that was issued by the Prime Minister some weeks ago that he is prepared to negotiate with Mungiki outlaws then followed by Last Sunday’s (18/05/2008)statement that all youths that spread terror and a harm during the post election violence to be offered amnesty. This has opened a pandoras box. Those who endorse the PM statement of a truce and welcome to negotiation are seen as sympathizer of the outlawed sect. The opponents argue that the amnesty should also be extended to others echoing the PM sentiments. Though I detest violence in any form, am of the view that the olive branch extend to Mungiki outlaw as a welcome alternative strategy to contain the groups. Since the war against the groups began some years back, it appears the Security Personnel are unable to eradicate the sector. This is given credence by the numerous time the groups resurfaces and spreads terror and violence to the citizenly. There are quite a number of groups adherent who have been alleged to have been executed especially in Central Province where the covert operation is mainly concentrated. This goes to show that the security officers have been eliminating the wrong people. Even through negotiation gesture it may be seen as giving into black mail but the cost the economy and the inconvenience the threats and terror brings to citizen( business and individuals) justifies the round table talks.

So, where does the distinction/characteristics between the outlawed Mungiki Sect and the democracy fighters emerge thus earning the former a truce and a right to be heard. While the former are organized violent group with a figure head (their jailed spiritual leader Maina Njenga). The latter lack any leader who have declared in public domain to be so. All we hear is the senior politicians calling for their release. The other aspect is that the democracy fighters are in jail awaiting the prescription of the due process whereas the security agencies have been unable to contain the Mungiki menace. This group did not begin spreading terror yesterday. It has been with us for a very long time and the securing organ were out witted by them. Therefore, it is logical to invite the on the negotiating table to hear their case.
